Diligence
In order to recover funds from debtors creditors have several court backed debt recovery tools at their disposal. These tools are generally utilised without the assistance of the court and are utilised to demonstrate an inability to pay a debt. Diligence is usually carried out to enforce a decree or recover funds due in response to an expired charge for payment or statutory demand (see charge for payment). Diligence can also be carried out in cases where a document is registered in the Books of Council and Session for execution (usually a commercial lease). Councils can use the summary warrant to enforce lease obligations.
